A. Terms and Conditions
1. The website, its databases and content.
We want you to use our website as often as you like. We reserve the right to withdraw or change the web sites service without notice, as our business evolves. We cannot be held liable if for any reason our site is unavailable at any time or for any period.
We need to carry out routine maintenance and servicing of our servers and equipment from time to time. While we will seek to keep disruption to a minimum we cannot guarantee that the website will be continuously available.
We cannot guarantee that the website (or partner websites which are linked to the website) is free from computer viruses or any other malicious or impairing computer programs. We recommend that you use appropriate security systems and virus checking software.
All the intellectual property rights (including copyright) in the content of these web pages, and in the photographs displayed, and all the database rights in databases, are owned or managed – and therefore protected – by us (generally, on behalf of our advertisers, suppliers, partners and other contributors).
Our content is valuable, and we want that value to be appreciated and used reasonably by all our users. But we need to recognise content creators have rights under law, and those rights must be respected. All content is subject to copyright. Some content may be offered for reuse, using creative commons licences. As a user, you agree that you will only use, reuse and reproduce content as permitted by law or licence. If you are unsure of the reuse rights associated with any particular piece of content, contact us.
All trade marks, names, and logos are the proprietary marks of us or of our partner companies. Marks identifying third parties are owned or licensed by those third parties or their associated companies. We do not grant you any licence or right under any trade marks, names or logos.
We want as many visitors as possible, so we encourage you to establish hypertext links (from your website, or from your social media) to the home page of the website, or other pages, without the need for our consent, provided there is no implied endorsement or sponsorship of you, your company or your website by us.
2. Reading content, and responding to adverts.
Our business depends on visitors reading our content, and responding to adverts, encouraging advertisers to advertise on our website, and we are very appreciative of your visits.
EVE content may sometimes contain basic errors, technical inaccuracies and other typographical errors. Information may be updated from time to time and may at times be out of date. Whilst we do our best, we cannot accept responsibility for keeping the information up to date or any liability for any failure to do so.
The information on the website is for information purposes only. The website contains material submitted and created by private sellers, dealerships, manufacturers, and other third parties, including individual commentators (some with VERY strong opinions). We exclude all liability for any illegality arising from or error, omission or inaccuracy in such material. You should not rely on any of our content to make any decisions or take any actions. You remain entirely responsible for your own decisions and actions.
The website publishes advertisements placed by third parties to advertise their goods and/or services (generally eco vehicles and related technologies, and events). We do not own or provide the goods and/or services advertised for sale on the website and have no liability for these or for any losses that you may incur as a result of purchasing or hiring any goods and/or services advertised by third parties. If you choose to purchase or hire goods and/or services advertised for sale by third parties on the website, the contract will be between you and the third party advertiser and not with us.
We give no warranties, conditions, guarantees or representations, express or implied, as to:
- the completeness or accuracy of the advice and information contained in any classified (product) listings, or any blogs, any comments, any other content, or any other linked website;
- the specific product-related information in the product listings or banner advertisements included in our databases, including but not limited to the ownership, quality, authenticity of any photographs, compliance with description or fitness for purpose of any goods or services;
One thing that is really important to us, and the success of our website; you must not use the contact details provided by private advertisers of vehicles to contact those advertisers other than in connection with a genuine enquiry relating to the purchase by you of the vehicle in question. Anyone found to be abusing contact information in breach of the law will be prosecuted accordingly.
3. Advertising goods and services
Our business runs on revenue generated from our advertisers, and we are appreciative you choose to advertise on our website. We hope our users respond positively to your adverts. Our users are encouraged to comment at all levels, so there is discussion and varied opinions on all our website content, including adverts. When you advertise with us, you accept that your advert might be critiqued and discussed, including possible negative comment. We will do our best to remove any offensive or unreasonable commentary, but we cannot be held liable for any slanderous or libellous comments. You can contact us to highlight potentially unreasonable commentary at any time, and we will make best efforts to reasonably respond to any concerns as soon as possible.
We reserve the right to remove any adverts deemed by us to be offensive, prohibited, or otherwise unlawful. No refunds will be provided in such cases.
Advertising fees are as specified on the website; or in other correspondence. Fees are inclusive or exclusive of any VAT or other sales taxes as applicable. Fees for classified advertising are generally paid via the website’s e-commerce system, as part of creating an advert (listing), immediately in advance of the listing appearing on the website. Therefore classified adverts cannot be cancelled. Refunds can only be provided if we fail to publish the listing as booked and paid for.
Display advertisers may be refunded (at least in part), if they choose to cancel their booking, before banners appear. Refunds will be offered as follows, dependent on the notice of cancellation received:
- 28 days or more before first banner display, 100% of total booking fee will be refunded
- 15-27 days before first display, 50% of total booking will be refunded
- 0-7 days before first display, no refund will be provided
For clarity, and as described above, all the material displayed on our website is provided without any guarantees, conditions or warranties as to its accuracy.
To the extent permitted by law, we, and our partners, expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our website or in connection with the use, inability to use, or results of the use of our website, any websites linked to it and any materials posted on it, including without limitation any liability for loss of business, income or revenue; profits or contracts; anticipated savings; data; goodwill; wasted management or office time; and for any other loss or damage of any kind, howsoever arising and whether caused by tort (including negligence), breach of contract or other wise, even if foreseeable.
We are not liable for any failure to perform any of our obligations under these terms and conditions caused by matters beyond our reasonable control.
This does not affect any liability which cannot be excluded or limited under applicable law.
We reserve the right to assign or subcontract any or all of our rights and obligations under these terms and conditions to a third party e.g. if we sell the website.
If any of these terms and conditions shall be held to be invalid or unenforceable, it shall not affect the enforceability of any of the remaining terms.
These terms and conditions shall be governed by and in accordance with English law and subject to the exclusive jurisdiction of the English Courts.
We routinely collect information about the users and usage of our site, including details of visits such as pages viewed and the services that users access, and other data that helps us develop the web site to better serve users. We generally use this data in aggregated form (as ‘usage data’ or ‘web analytics’).
To use certain services on the website you will need to register, and supply some personal data and/or information about the product or service you are advertising (e.g. classified for listing). You do this on a voluntary basis. It is our policy to keep registration requirements to a minimum, simply to facilitate the reasonable use of the services provided by the website, and that you may wish to use. Credit Card information is collected over a secure connection.
As part of the registration process, you will be given a username and password. You may need to register multiple times to use different services. By registering, you confirm that the information you supply is truthful, accurate and complete. You agree it is your responsibility to keep your usernames and passwords confidential. You also agree that you will not attempt to register in the name of any other individual nor will you adopt any username which we deem to be offensive. All your personal information will be processed in accordance with the 1998 Data Protection Act. We will not share your information with any third-party without your permission, unless required by law, or if we sell the web site to a third-party buyer. We may also store information that you provide us with when you communicate with us by any other means, so we can better serve you on an ongoing basis (e.g. in a customer service database). We may contact you from time to time with information about our business with you.
As you are well aware, sending information via the internet is not entirely secure and occasionally such information can be intercepted; websites can be hacked. Whilst we do our best, we cannot guarantee the security of data that you send us electronically, and sending or publishing personal data is entirely voluntary, and at your own risk.
The Data Protection Act 1998 gives UK users the right to access any information that we hold about them. If you request such access, we will charge a fee of £10 to cover the costs incurred by us in providing you with the information.
To function effectively the website requires cookies to be placed on your device. Your use of the web site indicates your acceptance of these cookies.
You can adjust the settings on your computer to decline any cookies if you wish. This can easily be done by activating the reject cookies setting on your computer.
D. Partner sites
The website contains hypertext links to websites that are not operated by us. We cannot and do not control such websites and are not responsible for their content. Our inclusion of hypertext links to such websites does not imply any endorsement of the material contained on the websites or of the owners. You should review their term sand conditions, and relevant privacy policies and cookie policies before using their websites, or sending them any personal data.
